Despite decades of heightened public pressure, stronger laws and stiffer law enforcement, drunk driving persists as a threat in Florida and across the country. More than 10,000 people died in alcohol-impaired driving crashes in 2010, according to the National Highway Traffic Safety Administration (NHTSA). And in Florida, there were 794 fatalities in Florida car crashes in 2010 that were determined to be alcohol related, the Florida Department of Highway Safety and Motor Vehicles says.
Car accidents caused by drinking drivers have tragic results. Lives can be lost. Families can be changed forever.

Drinking and Driving Accidents in Florida
Since 2002, it has been illegal in all 50 states to drive with a blood-alcohol concentration (or content) of 0.08 percent or higher. Under Florida law, a person may be found guilty of driving under the influence (DUI) by proving impairment of normal faculties by alcoholic beverages, chemical substances or controlled substances or by having a BAC of 0.08 percent or above.
Florida’s DUI law mandates fines, driver’s license suspension, community service, DUI school attendance, probation, installation of ignition interlock devices and possible jail time for individuals convicted of DUI.
Florida Department of Motor Vehicles (DMV) records show that in 2011:
- 55,722 drivers were cited for DUI
- 33,625 drivers were convicted of DUI.
DUI convictions in the larger Florida counties in 2010 included:
- Hillsborough County (Tampa) — 3,256
- Miami-Dade (Miami) – 2,274
- Duval County (Jacksonville area) – 2,222
- Pinellas County (St Petersburg) – 1,824
- Palm Beach County (West Palm Beach) – 1,561
- Orange County (Orlando) – 1,383
- Brevard County (Melbourne) – 1,072
- Broward County (Fort Lauderdale) – 985.
The 2010 Florida Crash Facts and Statistics report by the Florida Department of Highway Safety and Motor Vehicles (FLHSMV) lists:
|Alcohol-related car crashes||20,085||17,748|
|Alcohol-related fatal car crashes||921||746|
|Alcohol-related injury car crashes||8,994||7,825|
“The significant drop in alcohol-related fatalities (20.92 percent) is due to under reporting of Blood Alcohol Content (BAC) by law enforcement agencies,” the FLHSMV says.
A Florida driver does not have to be convicted of DUI to have been alcohol impaired and responsible for a drunk driving car accident. Nor does a driver have to be found legally drunk to be responsible for a personal injury or wrongful death that resulted from their decision to drink and drive.
