If you or a loved one is injured while riding a motorcycle and you’re not wearing a helmet, you can recover damages. Florida has a doctrine called comparative liability, which means the defense is allowed to mention that to a jury as a reason for why they’re not responsible for your damages, but that does not preclude or prevent you from bringing a claim.
