Surgical Negligence Lawyers

All surgeries carry a certain element of risk, and even skilled surgeons and modern medical centers in South Florida make mistakes that cause patients lasting harm or fatal injuries. Each year, hundreds of patients undergoing surgical procedures at hospitals, ambulatory care centers and doctors’ offices suffer avoidable injuries such as brain damage, spinal damage, surgery on the wrong body part, surgical tools left in their body, and surgery unrelated to their medical diagnosis. These medical mistakes may constitute surgical negligence on the part of the doctor or medical facility. Some patients have to have follow-up procedures to correct the harm done or must live with a permanent disability.

If you suspect that you or a loved one has been a victim of surgical negligence, turn to a knowledgeable Florida medical malpractice attorney for guidance. I am attorney Philip DeBerard. I have more than three decades of experience helping Florida families and individuals overcome personal injuries caused by surgical negligence by doctors, hospitals and surgical centers.

Medical malpractice is a complicated area of the law. So it’s critical to turn to an experienced Florida personal injury law firm with the resources to analyze and determine surgical negligence. The law firm of Philip DeBerard, Injury Attorney, focuses on helping victims of medical malpractice in South Florida and the Treasure Coast.

What the Statistics Say About Surgical Negligence in Florida

Hospitals, ambulatory surgical centers, nursing homes, and assisted living facilities are required to report incidents involving serious harm or death to patients to the Florida Agency for Health Care Administration. These are known as adverse event reports. In 2022, there were 8,603 reported adverse incidents in Florida health care, including:

  • 138 medical interventions performed without patient’s informed consent
  • 86 surgeries unrelated to the patients’ medical condition
  • 81 surgeries to remove foreign objects left behind from previous operations
  • 56 surgeries on the wrong body part
  • 21 surgical repairs of damage from previous surgeries
  • 21 wrong surgical operations
  • 13 medically unnecessary procedures
  • 6 surgeries performed on the wrong patients.

As you can see from these adverse event statistics, Florida surgeons and hospitals do frequently make mistakes that cause patients serious injury or, in the worst cases, death. When a Florida surgeon fails to follow the recognized standard of medical care in performing surgery or treating a patient, their action may constitute surgical negligence.

Surgical negligence may be caused by failing to monitor a patient properly before or after surgery, by improper anesthesia administered during surgery, by medical complications caused by error, by inadvertent puncture of an organ, or post-operative blood clots or internal bleeding.

Nationwide, about 4,000 surgical errors occur each year, according to medical publishing firm StatPearls.
