Pedestrians can be involved in a tragic accident at any time… even if people cross the road as safely as possible, they may still be at the mercy of a negligent motorists behind the wheel. Careless and reckless drivers have the potential to cause injuries to others because they tend to run red lights, fail to yield the right of way of other motorists or pedestrians, and/or drive too fast for the conditions.
Such an incident happened recently in Jupiter, FL. According to Jupiter Police, an adult woman was flown by Trauma Hawk to the hospital with serious injuries after she was struck by a vehicle around 8:07 p.m. on Dec. 24 in Jupiter. Investigation revealed the woman was crossing Indiantown Road when she was hit by a black Toyota Tundra traveling west in the 900 block of West Indiantown Road. The driver and passengers in the vehicle fled the crash scene and abandoned the vehicle in the next block. Jupiter Police are looking for the fleeing driver and passengers.
When a motor vehicle accident occurs, laws in Florida require drivers involved in the accident to remain at the scene of the crash until they are cleared by police. This law has very few exceptions. Drivers who fail to abide by this particular law may face traffic charges and a criminal charge for leaving the scene of an accident. However, the penalties leveled by the criminal justice system are not designed to provide monetary compensation for the crash victims or their families.
A hit-and-run accident can change or take the life of any individual near the street or on the roadway, not just the people inside vehicles. Unfortunately according to statistics many pedestrians are victims of hit-and-run accidents in Florida each year, and they are often more severely injured than they would be if they had been in a vehicle.
If the driver is never found, the victim may be entitled to seek financial relief from their own insurance company through a under-insured motorists’ claim. If the driver is later apprehended, the injured victim can possibly then file a negligence claim against the driver.
