According to the PalmBeachPost.com, Gerald Smith, 82, of Boynton Beach, was killed Wednesday afternoon in a car crash at the intersection of Federal Highway at First Street in Delray Beach.

The car that ran into Smith’s Buick Enclave was a Lamborghini driven by fitness mogul Roger Wittenberns. Wittenberns was thrown from his vehicle but survived. Smith, however, died shortly after the accident at Delray Beach Medical Center.

Wittenberns’ wife was traveling alongside her husband in a Porsche. She fled the accident scene as soon as the two other vehicles collided.

Accident investigators are looking into whether speed and alcohol on the part of Wittenberns played a role in the accident. No charges have yet been filed.

The particular intersection is also under scrutiny as it has a long record of collisions. The State of Florida has begun a study to determine if a traffic light is needed at that location.

We at DeBerard Injury Attorney are troubled and saddened by this tragedy. We hope for the best for the family of the deceased. As to the accident itself, a wrongful death claim can arise when the negligence of another causes a fatality.
