Tractor Trailer Fatally Hits Pedestrian on I-95 in St. Lucie County

Tractor trailers and other commercial trucks are among the most potent threats to pedestrians. The high rates of speed at which large trucks travel on Florida highways pose a real danger to the safety of people on foot sharing the road with gigantic trucks. When trucks collide with pedestrians, the pedestrians are exponentially more vulnerable to catastrophic and even fatal injuries.

The Florida Highway Patrol said a 52-year-old Hobe Sound man was killed on Interstate 95 in St. Lucie County after he was struck by a semi truck on Sept. 3. A preliminary investigation revealed the victim had parked his car on the south outside right the shoulder of I-95. He got out of his car and ran into the center lane.

At the same time, a tractor trailer driven by a 32-year-old Nevada man was traveling south in the center lane just before Indrio Road when the pedestrian ran into the path of the truck. The truck driver attempted to avoid the pedestrian, but still struck the pedestrian, who was pronounced dead at the scene. The tractor trailer jackknifed. Authorities are still investigating the crash.

Serious truck-pedestrian accidents can occur when drivers ignore the pedestrians’ right of way or fail to obey the rules of the road, and when pedestrians walk or cross the road without looking out for oncoming vehicles. Because pedestrians are not protected by physical barriers, they are susceptible to serious injuries.

Authorities are still investigating the recent fatal pedestrian accident on I-95, the decedent’s family members may wonder if they are entitled to recover damages for their loved one’s death and their losses. Florida’s comparative negligence law allows injured crash victims, even if they have contributed to their own injuries, to sometimes recover damages. However cases involving comparative negligence are complex and best left in the hands of an experienced Florida personal injury law firm.
