Motorists understand that a traffic accident can happen at any moment without warning of any kind. To minimize the chances of being involved in an accident, driver needs to give the road their complete attention. When one driver fails to exercise due care while driving, a serious or fatal wreck can occur as was the case last week in a fatal auto accident that killed two people from Port St. Lucie.

The Florida Highway Patrol said the 82-year-old male driver of a 2010 Toyota Prius and his female passenger, 75, were both pronounced dead at the scene following a car wreck near the Florida’s Turnpike ramps.  Preliminary investigation revealed that at around 6:50 a.m., the Toyota Prius occupied by the victims was traveling southbound on a green signal into Martin Downs Boulevard’s intersection with Martin Highway when it was struck by a westbound 2013 Ford F350 truck.

The truck that hit the left side of the Prius was driven by a 31-year-old Hialeah man.  Both the Ford truck driver and his 28-year-old passenger were uninjured. Authorities believe the truck driver was not under the influence of either alcohol or drugs at the time of the crash.

The FHP is still investigating the fatal wreck, and more details about the collision will likely be released at a later time. In the meantime, the victims’ family members are still left to wonder whether they can seek a wrongful death claim for each victim.  A Port St. Lucie personal injury attorney would be required to help ascertain if there was any negligence on the part of the truck driver and if a claim wrongful death claim is possible. If negligence can be proved the families may seek first-party benefits, and may pursue a negligence lawsuit against the driver of the Ford truck for damages.

The only thing we know right now is that the victims’ vehicle was traveling the road on a green signal when the fatal collision occurred.
